Khawaja Asif says according to his opinion Imran Khan being bowler is ‘Relu Katta’ and his bowling has become ‘Phateacher’
ISLAMABAD, Mar 20 (SABAH): The Supreme Court of Pakistan on Monday dismissed the review petition filed by Pakistan Tehreek-e-Insaf’s (PTI) candidate Usman Dar for declaring the election of Khawaja Muhammad Asif as MNA from NA-110 Sialkot null and void on the allegations of rigging.
A three-member bench headed by Chief Justice of Pakistan Mian Saqib Nisar and comprising Justice Ijazul Ahsan and Justice Sajjad Ali Shah upheld the decision by the apex court from last year, when the Supreme Court had rejected PTI’s appeal against Khawaja Asif.
During the hearing Usman Dar’s counsel Babar Awan argued that the record of three polling stations has not found till today, adding that 8773 counter files have also not been found. He said the meeting of Khawaja Asif with the polling staff is the part of record.
Chief justice said the record is thrown in “Mall Khana”, adding that there is no ground by following which verdict could be reviewed. Chief justice observed that if bogus votes are excluded after that the margin of victory of Khawaja Asif is 15000 votes.
During the hearing, CJP said that election cannot be annulled by presenting only 10 witnesses. He said that it might be possible that these witnesses would be your supporters and voters.
Justice Saqib Nisar said that the people presented as witnesses could be either supporters or voters of the said petitioner, so they could not be declared impartial. Chief justice said Usman Dar has not presented any neutral witness.
The chief justice further said that unattested votes could not be eliminated from counting. How can one examine that how the seals of polling bags were broken, he raised a question.
Justice Nisar also said that Dar failed to present himself before the election tribunal despite several summons. “He did not turn up before the tribunal even when he was fined. To be there for cross questioning was a legal requisite,” he added. The court while maintaining the success notification of Khawaja Asif has dismissed the review petition of Usman Dar.
Meanwhile talking to a private TV channel Defense Minister Khawaja Muhammad Asif said he is thankful to Almighty Allah over the Supreme Court decision. Khawaja Asif said that PTI lost in general election, in tribunal, in appeal and in review petition. He said Imran Khan was saying my wicket is going to fell but with the blessings of Almighty Allah, I was batting in past and also continuing batting. Asif said according to his opinion Imran Khan being bowler is “Relu Katta” and his bowling has become “Phateacher”.
Earlier on 10 November 2016, the apex court had rejected a petition challenging his election from the NA-110 (Sialkot) constituency.
The minister had bagged 92,484 votes, against his main rival Usman Dar’s 71,573 votes during the May 2013 general elections.
NA-110 (Sialkot) is one of the four constituencies — apart from NA-122 (Lahore), NA-125 (Lahore), and NA-154 (Lodhran) — which remained the focus of the PTI’s attack in their campaign to establish rigging in the 2013 elections.
Khawaja Asif’s counsel Farooq H. Naek said that the petitioner failed to provide any evidence to Election Tribunal to prove rigging in the constituency.
On July 23, 2015, a three-member inquiry commission probing into alleged rigging in 2013 elections rejected the allegations and said that the polls were conducted fairly and according to the law.
The election tribunal had earlier decided in favour of Khawaja Asif, following which Usman Dar had challenged the tribunal’s decision in the Supreme Court – which the apex court had upheld in November 2016.
PTI’s Sialkot leader Usman Dar had then filed a review appeal seeking disqualification of Khawaja Asif, which was again shot down by the Supreme Court on Monday which endorsed the Defence Minister’s victory in the May 2013 general elections from NA-110 Sialkot constituency.
